LIABILITY WAIVER

1. Definition of Activities
“Activities” include, but are not limited to, use of the indoor playground, climbing structures, play equipment, toys, foam features, slides, obstacle courses, interactive play elements, birthday parties, classes, camps, special events, and all other recreational activities conducted at Short Support Behavior Consulting, LLC DBA The Play Studio facility located at 111 North County Highway 393 Suite 404 in Santa Rosa Beach, Florida.

2. Parent Supervision Requirement
The Play Studio is a parent-supervised play environment.
I understand and agree that:

• I am solely responsible for supervising my child(ren) at all times.

• I must remain on the premises while my child participates in Activities.

• Employees of The Play Studio do not provide individual child supervision.

• I assume full responsibility for the safety and behavior of my child(ren) while on the premises.
   

3. Assumption of Risk
I understand that participation in the Activities involves inherent risks, including but not limited to:

• Slips, trips, or falls

• Collisions with other participants or equipment

• Injuries resulting from climbing, jumping, crawling, or active play

• Equipment malfunction or misuse

• Exposure to communicable illnesses

• Injuries ranging from minor scrapes and bruises to severe injuries including fractures, concussions, paralysis, or death.

I acknowledge that these risks cannot be completely eliminated and voluntarily assume all risks associated with participation in the Activities for myself and the minor Participant(s).

4. Release of Liability
To the fullest extent permitted by the laws of the State of Florida, I, on behalf of myself and the minor Participant(s), hereby release, waive, discharge, and agree not to sue Short Support Behavior Consulting, LLC DBA The Play Studio, its owners, members, managers, employees, contractors, volunteers, affiliates, agents, landlords, and property owners (collectively referred to as “Released Parties”) from any and all claims, liabilities, demands, damages, losses, or causes of action arising out of or related to:

• Participation in the Activities

• Use of the facility or equipment

• Injury, illness, property damage, or death

including claims arising from the negligence of the Released Parties, except in cases of gross negligence or intentional misconduct.

5. Indemnification and Hold Harmless
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses (including attorney’s fees) arising from or related to:

• My participation or the participation of the minor Participant(s)

• Failure to supervise my child

• Violation of facility rules or policies

 

6. Health & Illness Policy
I agree NOT to bring my child to The Play Studio if they are experiencing symptoms of illness including fever, vomiting, diarrhea, or other contagious conditions. I acknowledge that participation in public activities carries a risk of exposure to illness.

 

7. Medical Authorization
In the event of an accident or medical emergency involving the Participant(s), I authorize The Play Studio staff to obtain emergency medical assistance if necessary. I understand that I am responsible for any medical expenses incurred.

 

8. Security Cameras
I understand that security cameras may be present within the facility for safety and security purposes and may be referenced in the event of incidents or injuries.

 

9. Photo & Media Release
I grant permission for The Play Studio to use photographs or video taken within the facility that may include myself or the minor Participant(s) for marketing, promotional, or social media purposes without compensation.

 

10. Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida, and any legal action related to this Agreement shall be brought exclusively in the courts located in Walton County, Florida.

 

11. Electronic Signature Agreement
By checking the required waiver box and signing electronically, I acknowledge that:

• I have read and fully understand this Agreement

• I understand that I am giving up substantial legal rights

• I am signing this Agreement voluntarily

• My electronic signature is legally binding and equivalent to a handwritten signature.

 

12. Parent/Guardian Certification
I certify that I am the parent or legal guardian of the minor Participant(s) and that I have the legal authority to execute this Agreement on their behalf.
I acknowledge that this waiver remains valid for all future visits to The Play Studio unless revoked in writing.
